This is an English translation of the Russian original. In case of any discrepancy, the Russian text prevails (clause 11.3).
These Rules set out the terms on which registered Users post listings for the sale of real estate on the Website. The Rules are an integral part of the Terms of Use (public offer). By posting a listing, the User confirms that they have read the Rules and agree to them.
1. Who May Post Listings
1.1. Listings are posted by a User who has registered on the Website, confirmed their email address and is at least 18 years old.
1.2. The User posts a listing for a property that they own, or acts on the owner’s instructions. At the Operator’s request, the User confirms their ownership or authority.
1.3. A private individual may have no more than 5 (five) published listings at a time.
1.4. Real estate agencies and developers post listings after being verified by the Operator and granted the corresponding status. Posting an agency’s or a developer’s listings in the guise of a private individual is prohibited.
2. Listing Requirements
2.1. One listing describes one property that actually exists and is for sale at the time of posting.
2.2. The details of the property are accurate and up to date: type, location, area, number of rooms, price, condition and construction stage.
2.3. The price is stated in full and in one currency.
2.4. The photographs show this particular property. The User is their author or is entitled to use them.
2.5. The listing text is written without markup and contains no links, phone numbers, email addresses or messenger usernames. Contact details are given only in the User’s profile.
2.6. An agency or a developer that publishes details of its staff on the Website (names, photographs, contacts) confirms that it has obtained those staff members’ consent to the publication.
3. What Is Prohibited
3.1. Posting listings for properties that are fictitious, sold or do not belong to the User.
3.2. Posting several listings for the same property.
3.3. Using other people’s photographs, photographs bearing the watermarks of other websites, and images unrelated to the property.
3.4. Advertising third-party services and websites in a listing, or placing contact details in the text or on the photographs.
3.5. Including discriminatory terms, insults or information whose distribution is prohibited by law.
3.6. Using the Website to collect visitors’ contact details for purposes unrelated to the listing.
4. Review of Listings
4.1. Every listing is reviewed by the Operator before publication. The review usually takes up to 3 (three) business days.
4.2. The Operator may reject a listing or request clarifications or proof of authority. The reason for rejection is communicated to the User in their account.
4.3. A change to the text, photographs or address of a published listing sends it for a new review; the listing is not displayed until the review is complete. A change of price and a “sold” mark take effect immediately.
4.4. The Operator’s review is formal: the listing is checked against the presentation requirements of Sections 2 and 3. The Operator does not verify or confirm the accuracy of the information, the ownership of the property, the User’s authority, or the rights to the photographs and texts. Publication of a listing after review does not mean that the Operator has approved its content and does not make the Operator liable for it.
5. Listing Period
5.1. A listing is published for 90 (ninety) days. 7 (seven) days before the period ends, the User receives a reminder and may extend the listing.
5.2. A listing that has not been extended is removed from publication and kept in the User’s account.
5.3. The User removes the listing or marks the property as sold as soon as the property is no longer for sale.
6. Fees
6.1. Posting listings within the limits set by these Rules is free of charge.
6.2. The Operator may introduce paid services and change the limits of free posting. The Operator gives notice of such changes on the Website and by email at least 14 (fourteen) days in advance. A listing published before the change remains on the Website on the previous terms until the end of its paid or current listing period.
7. Rights to Listing Materials
7.1. The User retains the rights to the texts and photographs of the listing.
7.2. By posting a listing, the User permits the Operator, free of charge and for the listing period, to use its materials in the following ways: to reproduce and display them on the Website, to store them, to process images (change their size and format), to translate the text into the other languages of the Website, including automatically, and to show them in the Website’s search results and newsletters.
7.3. The listing is translated automatically and the translation is marked as machine translation. In case of any discrepancy between the translation and the original, the original prevails.
8. Inquiries About a Listing
8.1. Inquiries from Website visitors about a listing are passed on to the User in their account and by email.
8.2. The User uses the information from an inquiry only to reply about that listing, does not pass it on to third parties, and stops using it once it is no longer needed for that purpose.
9. Role of the Operator
9.1. The Operator is an information intermediary (Article 1253.1 of the Civil Code of the Russian Federation). The Operator is not a seller, a party to the transaction, the User’s agent or a payment intermediary, and does not verify the ownership of properties.
9.2. The User who posted the listing is responsible for its accuracy, for the lawfulness of posting it, including under the rules of the country where the property is located, and for respecting the rights of third parties.
9.3. The Operator is not liable for the content of listings, including those that have passed review, for the actions of the Users who posted them, or for how those Users use the information from visitors’ inquiries. The Operator takes no part in negotiations or settlements between a visitor and the author of a listing and is not responsible for their outcome.
9.4. If third parties bring claims against the Operator in connection with a listing, including claims of infringement of rights to photographs or texts, the User settles them on their own and at their own expense and compensates the Operator for the losses incurred in this connection.
10. Reports and Violations
10.1. Any visitor to the Website may report a violation using the “Report” button on the listing page.
10.2. If these Rules are violated, the Operator may remove the listing, restrict the posting of new listings or block the account. The reason is communicated to the User.
10.3. The Operator may retain information about a listing and an account that has been reported or restricted for the period specified in the Privacy Policy, including after the account is deleted.
10.4. The User may contest the Operator’s decision by writing to the Operator’s email address. The Operator replies within 10 (ten) business days.
11. Changes to the Rules
11.1. The Operator may change these Rules. The current version is available at homzer.com/listing-rules/.
11.2. A listing is governed by the version of the Rules in force when it was posted or last extended.
11.3. These Rules are drawn up in Russian. In case of any discrepancy between the Russian text and a translation, the Russian text prevails.
