This document sets out the terms of the consent given by a visitor to the website homzer.com (the “User” or “data subject”) when submitting a request or any other contact form on the Website. The operator of personal data is Individual Entrepreneur Anton Aleksandrovich Ivanov (Taxpayer ID (INN) 164492149360, OGRNIP 316169000109745; mailing address: 7 Kropotkinsky Lane, Bldg. 1, Moscow, Russia; email [email protected]) (the “Operator”).

The consent is given freely, of the User’s own will and in the User’s own interest, and is specific, informed, conscious, and unambiguous (Article 9 of Federal Law No. 152-FZ “On Personal Data” of July 27, 2006, “Law 152-FZ”). By checking the consent box and submitting the form, the User confirms that they are at least 18 years old and accepts the terms set out below.

1. Consent to the Processing of Personal Data

The User consents to the Operator’s processing of the following personal data entered by the User in the form or collected automatically:

  • name (as provided by the User);
  • phone number;
  • email address;
  • the text of the request and details of the request (country, budget, type and parameters of the property of interest, preferred contact method);
  • technical data: IP address, browser information (user agent), referring page, date and time of the request, cookie and UTM tags.

The data are processed for the following purposes: reviewing and handling the request; contacting the User; selecting properties and preparing offers; forwarding the request to partners (see Section 2); and complying with the laws of the Russian Federation.

The consent covers the following actions with personal data: collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (provision, access), blocking, deletion, and destruction, with or without the use of automation tools.

2. Consent to the Transfer of Personal Data to Third Parties (Partners)

The User consents to the transfer (provision) of their personal data (name, phone number, email, content and parameters of the request) to the Operator’s partners for the purpose of contacting the User, selecting properties, preparing and sending offers, arranging viewings, and supporting the transaction. Categories of recipients:

  • Russian partners — legal entities and individual entrepreneurs registered in the Russian Federation (real estate agencies, lawyers, partner banks, listing aggregators).
  • Foreign partners — real estate and development companies, real estate agencies, and property sellers located in the country where the property of interest to the User is located, or in another country where the Operator works with a partner in the relevant area.

Data are transferred to the extent necessary to contact the User and prepare an offer in response to the User’s request. The Operator does not sell contact databases and does not transfer data for advertising goods or services of persons unrelated to the User’s request.

3. Consent to Cross-Border Transfer

Because some of the Operator’s partners (Section 2) are located outside the Russian Federation, the User consents to the cross-border transfer of their personal data to foreign countries in accordance with Article 12 of Law 152-FZ — to the country where the property of interest or the relevant partner is located.

The User has been informed and confirms that the transfer may be made, among others, to foreign countries that do not provide adequate protection of the rights of personal data subjects, and is aware of the related risks. Consent to cross-border transfer to such countries is given by the User in accordance with Part 4 of Article 12 of Law 152-FZ. The Operator carries out cross-border transfer only after filing the relevant notification with Roskomnadzor under Part 3 of Article 12 of Law 152-FZ.

4. Term of Consent and Procedure for Withdrawal

The consent is valid from the moment the form is submitted until the User withdraws it, or until 3 (three) years have passed since the last interaction, whichever occurs first, unless a different period is required by the laws of the Russian Federation.

The User may withdraw consent at any time by sending a request to [email protected] with the subject line “Withdrawal of consent”. Upon receiving the withdrawal, the Operator stops processing and transferring the personal data, except where processing is required by law (Part 2, Article 9 of Law 152-FZ). Withdrawal of consent does not automatically extend to processing of previously transferred data that a partner carries out as an independent operator; to stop such processing, the User should contact the relevant partner.

5. Consent to Receive Marketing and Informational Communications

This consent is given separately and is voluntary. It is not a condition for accepting a request, selecting properties, or providing any other services (Article 16 of the Law of the Russian Federation “On Protection of Consumer Rights”). By checking the separate box in the form, the User, in accordance with Part 1 of Article 18 of Federal Law No. 38-FZ “On Advertising” of March 13, 2006, consents to receiving marketing and informational communications from the Operator (new properties, curated selections, promotions and special offers, analytical materials) through the following channels:

  • email;
  • messaging apps (WhatsApp, Telegram);
  • phone calls.

The User may opt out of these communications at any time: via the “unsubscribe” link in an email, by replying in a messaging app, by an oral request during a call, or by writing to [email protected]. Upon receiving the opt-out, the Operator immediately stops sending advertising to that User.
